| 4. PA on 18 June of that same year was invited by M to go to Nara
Kenko (health) land with M and W, where they had a good time
together. 5. On the 22nd and 23rd June of that same year, along with M and a person called "sensei" (teacher) also known as Takeuchi (Hereinafter, Takeuchi) carried out a ceremony for the deceased at PA's home. On this occasion, Takeuchi prayed, everybody sang together a song called "Furusato" (hometown)and PA read a letter written by her deceased husband. At this time, PA was emotionally moved and cried. 6. PA's induction to the Defendant. Around 18 July of that same year, PA was shown a video titled "Shu no Rotei" (the way of god) which portrayed how Moon underwent various forms of persecution. At this point, the roles of the Defendant and Moon were evident.However, at this time, PA had now knowledge about the Defendant or Moon. After that, PA on 21 July of that same year, went to the Defendant's Nara church where she prayed and then signed a membership paper. Around 21-22 July, PA heard M say "at last you will be liberated from the spiritual world." 7. Events leading up to the donation On 23 July after PA went to the Nara culture center around 1:00pm. M took PA to an apartment in Nara city. There, PA, Takeuchi, M and Kobu (person) were present. They all prayed. Takeuchi spoke to PA about the meaning of giving donations and " Liberation from the spiritual world" took place. Next, Takeuchi told PA such things as:" The money you have now is dirty money...now that you have been liberated from the spiritual world, please give all your money to god";"You have just been liberated from the spiritualworld...If you do not offer your money to god, then you'll go back to where you started (shamefully)"; and " Give your money and when your ill fate has been removed, your son will find a good partner for marriage, for sure." The Kubo said to PA that he had no money, so he was working voluntarily. After about 30 minutes, Takeuchi got up and left the room while M and Kubostayed and persuaded PA. Around the evening, PA felt that if she did not say that she was going to give money, they would not let her leave.. M's face looked much more strict or stern than usual. PA felt if she did not say she would make a donation, then M would lose face or his stance with Takeuchi. She also felt great anxiety that if she did not donate money, that all the ill fate which was removed form her life would return to as it was before. Finally, PA agreed to make a donation. As to the amount of the donation, PA initially said she would give 500,000yen but M who had heard that PA had 4,000,000 yen said "That's too little" and "Give everything!". In response, PA said, " I must have the first anniversary of my husband's death and I need money for my son's wedding so Icertainly cannot give all my money." The M said "At least give half" and "Ifit is difficult for you to release, I can negotiate at the bank for you." Again PA felt that if she did not say she would give the money then they would not allow her to leave so she offered to give 2,000,000 yen. Then M gave an explanation of Genrikyo (Fundamentalist teachings) and the said " 2,000,000 is a bad number, give 2,100,000 yen." At the end, it was decided that PA donate a sum of 2,100,000 yen. Moreover, PA was told by M " Because you have only given half of your money, bring the remaining money. I will cleanse it for you. I will keep it for you for 6 months. So subtracting the 2,100,000 yen donation from her total sum of 4,000,000 yen left a remainder of 1,900,000 yen which PA promised she would give to M to keep for her. 4. Damages awarded to PA Based on the above admissions, it is further admitted that due to the unlawful acts of soliciting donations by the Defendant, PA should receive the following payment for damages: 1. Sum of donations: 2,100,000 yen 2. Attorney Fees: 250,000 yen Based on considerations concerning such elements as the contents of this case, the course of the trial, and the admitted costs, it is appropriate to include the attorney fees listed above which should be burdened by the Defendant. 3. In conclusion, PA's claims are reasonable. Accordingly, PA shall be awarded the total sum of 2,350,000 yen and according to civil law respecting late payment penalties, shall be awarded five per cent of thissum per annum dating from 17 May 1994, Higashi Osaka Culture Centeruntil the date full payment is made. |
